SleepMethod Terms of Service

These Terms govern your use of the SleepMethod website, mobile application, test versions and related services. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About SleepMethod
SleepMethod is a behavioral sleep wellness service. In these Terms, “SleepMethod”, “we”, “us” and “our” refer to the operator of SleepMethod. “Service” means our website, mobile application, content, features and related services.

2. Eligibility
SleepMethod is intended for adults aged 18 and older. You may only use the Service if you are at least 18 years old and legally able to agree to these Terms.
Information you provide must be accurate and must not impersonate another person.
3. What the Service provides
SleepMethod can help you:
- Explore patterns related to circadian rhythm, sleep pressure and stress regulation.
- Receive a personal starting plan.
- Build and maintain sleep-supporting habits.
- Complete check-ins and review changes over time.
- Use educational content, guided breathing, meditation and Wind Down routines.
- Adjust your plan as you learn what is practical and useful for you.
Any analysis, status, recommendation or plan is an estimate based on information you provide. It is not a physiological measurement and may change as more information becomes available.
Features may be improved, replaced, added or removed. Material changes affecting a paid service will be communicated where required by law.
4. Health and safety
4.1 Not medical care
SleepMethod provides general wellness and educational guidance. It is not a medical device, healthcare provider, diagnostic service, treatment or emergency service.
The Service does not diagnose, prevent, cure or treat insomnia, sleep apnea, mental health conditions or any other medical condition. We do not guarantee that using the Service will improve your sleep or produce a particular health outcome.
4.2 When to seek professional help
Contact a qualified healthcare professional if sleep problems persist, you suspect an underlying condition or you are concerned about your sleep or health.
Seek urgent local assistance when you believe there is an immediate safety or health risk.
Do not use breathing, meditation or relaxation exercises while driving, operating equipment or doing anything that requires your full attention.
Do not drive or perform another unsafe activity when you feel at risk of falling asleep.
4.3 Your responsibility
You decide whether a recommendation is suitable for your personal circumstances.
Stop an exercise if it causes significant discomfort, distress, dizziness, breathing difficulty or another concerning response.
Advice from a qualified healthcare professional takes priority over general information provided by SleepMethod.
5. Accounts and security
An account may be required for personalization, synchronization or paid features.
You are responsible for protecting your account credentials and for activity performed through your account. Contact us promptly if you believe someone has accessed your account without permission.
You must not impersonate another person, provide deliberately false information or create an account for someone else without appropriate authority.
When account functionality is available, you may request account deletion through the app or by emailing support@sleepmethod.app.
Deleting your SleepMethod account and cancelling an app-store subscription are separate actions.
6. Personal plans and recommendations
SleepMethod may personalize content using your answers, preferences, completed habits, saved routines and check-ins.
Personalization is intended to make general wellness guidance more relevant. It does not constitute a medical diagnosis, professional assessment or individualized medical treatment.
Content may include:
- Suggested routines.
- Habit descriptions.
- Timing windows.
- Educational information.
- Guided audio exercises.
- Reminders.
- Personal focus areas.
Recommendations are not prescriptions, promises or guarantees. You remain responsible for deciding whether and how to follow them.
7. AI-assisted meditation and audio content
Some meditation scripts, spoken voices, soundscapes or other audio content in SleepMethod may be created, narrated or otherwise produced with the assistance of artificial intelligence.
AI-assisted content is provided for general relaxation, educational and wellness purposes. It is not a live interaction with a human instructor, therapist or healthcare professional and must not be treated as individualized medical or mental health advice.
We aim to review content before publication, but AI-assisted material may still contain limitations or errors. Stop using an exercise if it causes discomfort or distress and contact a qualified professional when you need personal medical or mental health support.
8. Testing and pre-release access
Beta, preview or testing versions of SleepMethod may be incomplete, change without notice and contain errors.
Testing access may be limited, suspended or withdrawn at any time.
Do not rely on a pre-release version of SleepMethod for medical, emergency or safety-critical purposes.
If you voluntarily provide suggestions or feedback, you allow SleepMethod to use them to improve the Service without an obligation to compensate you.
This does not change the protections that apply to personal information contained in your feedback.
9. Subscriptions and purchases
9.1 Current website
SleepMethod does not currently sell subscriptions directly through this website.
If paid features are introduced, the relevant checkout screen will show the price, billing period, included features, renewal terms, cancellation method and any trial conditions before you purchase.
The information shown at checkout will form part of your purchase agreement.
9.2 App Store and Google Play purchases
If you purchase through Apple App Store or Google Play, the relevant store processes your payment.
The store’s billing, renewal, cancellation and refund rules also apply to that transaction.
You can manage or cancel a store subscription through your Apple or Google account settings.
Deleting the SleepMethod app or your SleepMethod account does not automatically cancel a store subscription.
9.3 Automatic renewal
If a subscription automatically renews, the renewal period, applicable price and cancellation deadline will be displayed before purchase.
Cancellation stops future renewals. Unless applicable law or the relevant store rules provide otherwise, you may continue using paid features until the end of the period already paid for.
9.4 Trials and promotional offers
SleepMethod does not offer a free trial unless a trial is expressly displayed at checkout.
When a trial is offered, its duration, eligibility requirements, post-trial price and automatic renewal terms will be displayed before activation.
A trial may convert into a paid subscription unless you cancel before the displayed deadline.
9.5 Refunds and consumer rights
For purchases made through Apple App Store or Google Play, refund requests should normally be submitted through the relevant store.
Nothing in these Terms removes mandatory consumer rights. Any terms shown at checkout form part of the applicable purchase agreement.
10. Licence and intellectual property
SleepMethod and its licensors own the Service, including its software, design, text, graphics, audio, trademarks and other content, except where expressly stated otherwise.
We grant you a personal, limited, revocable, non-exclusive and non-transferable licence to use the Service for your own lawful, non-commercial purposes under these Terms.
Unless applicable law expressly permits it, you may not:
- Copy, sell, rent, sublicense, redistribute or commercially exploit the Service or its content.
- Reverse engineer, decompile or disassemble the Service.
- Attempt to obtain its source code.
- Bypass security measures, paywalls, access controls or technical restrictions.
- Remove copyright, trademark or ownership notices.
- Use our content to create a competing product or training dataset without written permission.
11. Acceptable use
You must not:
- Use the Service unlawfully or to harm another person.
- Interfere with the Service, its infrastructure or another user’s access.
- Introduce malware, abusive traffic or other harmful code.
- Use unauthorized automated systems to scrape or extract content.
- Attempt unauthorized access to an account, system or data.
- Infringe intellectual property, privacy or other legal rights.
- Misrepresent SleepMethod content as medical advice.
- Use the Service in a manner that creates an unreasonable safety or security risk.
12. User information and feedback
SleepMethod does not currently provide public posting or user-to-user content features.
You retain ownership of private answers, preferences, notes and other information you enter into the Service.
You allow us to host and process this information only as needed to operate, secure, personalize and improve the Service, as explained in our Privacy Policy.
Feedback may be used to improve SleepMethod without an obligation to compensate you. This does not transfer ownership of personal information contained in that feedback.
13. Privacy
Our Privacy Policy explains:
- What personal information we collect.
- Why we use it.
- The legal bases we rely on where applicable.
- How long information is retained.
- When information is shared.
- The rights available to you.
The Privacy Policy is separate from these Terms. Accepting these Terms does not constitute consent to data processing where the law requires separate consent.
14. Third-party services
The Service may rely on or link to third-party services, including:
- Apple App Store.
- Google Play.
- Authentication providers.
- Cloud storage.
- Notification services.
- Audio-delivery services.
- Crash diagnostics.
Third parties may apply their own terms and privacy policies.
We are responsible for our own Service, but not for third-party services we do not control, except where applicable law provides otherwise.
15. Availability, maintenance and updates
We aim to keep the Service available and reliable but do not promise uninterrupted or error-free operation.
Access may be affected by:
- Maintenance.
- Software updates.
- Device compatibility.
- Internet access.
- Third-party systems.
- Security incidents.
- Events outside our reasonable control.
You may need to install updates to continue using the Service securely.
We will provide updates and remedies required by applicable law.
16. Suspension and termination
You may stop using the Service at any time.
We may restrict or suspend access where reasonably necessary to:
- Protect users or the Service.
- Address suspected fraud.
- Investigate security incidents.
- Comply with legal obligations.
- Respond to a serious or repeated breach of these Terms.
Where appropriate and legally required, we will provide notice and a reasonable opportunity to correct the issue.
We may discontinue the Service. If discontinuation materially affects a prepaid service, we will provide any notice, continued access, refund or other remedy required by law.
Provisions that by their nature should continue after termination will remain effective.
17. Service standards and disclaimers
We will provide the Service with the care and skill required by applicable law.
General wellness guidance cannot account for every person, medical condition, device, environment or circumstance.
Subject to our legal obligations, the Service is provided on an “as available” basis.
We do not exclude any statutory right, warranty or guarantee that cannot legally be excluded.
18. Limitation of liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation.
If you use the Service as a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use legally required care and skill.
We are not responsible for:
- Losses that were not reasonably foreseeable.
- Business losses resulting from personal consumer use.
- Loss caused by your failure to follow reasonable instructions.
- Loss caused by incompatible, unsecured or improperly maintained equipment.
The Service is intended for personal consumer use and is not offered for business, medical or professional use.
Mandatory consumer rights and remedies remain unaffected.
19. Governing law and disputes
These Terms are governed by Dutch law.
If you are a consumer, this choice does not remove mandatory protections provided by the law of your usual country of residence.
Please contact support@sleepmethod.app first so we can try to resolve a concern informally.
You may bring a dispute before any court that has jurisdiction under applicable consumer law.
Nothing in this section prevents either party from seeking urgent legal relief or using a mandatory consumer dispute process.
20. Changes to these Terms
We may update these Terms to reflect changes to:
- The Service.
- Applicable law.
- Security requirements.
- Our business.
- Third-party services.
We will provide reasonable advance notice of material changes where required.
The notice will explain when the revised Terms take effect and what choices are available to you.
Changes will not retroactively reduce rights connected to an existing purchase unless legally permitted and appropriately agreed.
21. General terms
If one provision of these Terms is found to be unenforceable, the remaining provisions continue to apply.
A failure to enforce a provision does not waive that provision.
We may transfer these Terms as part of a merger, acquisition, restructuring or sale of the Service, provided this does not reduce mandatory consumer rights.
You may not transfer your rights or obligations under these Terms without our permission, except where applicable law allows it.
These Terms, any applicable checkout information and any additional terms expressly presented for a feature form the agreement relating to your use of the Service.
22. Apple App Store terms
If you download SleepMethod through Apple App Store:
- These Terms are between you and SleepMethod, not Apple.
- SleepMethod, not Apple, is responsible for the app and its content.
- Your licence is limited to using the app on Apple-branded products you own or control, subject to Apple’s applicable usage rules.
- Apple has no obligation to provide maintenance or support for the app.
- Where an applicable warranty cannot legally be excluded and the app fails to conform to it, you may notify Apple. Apple may refund the purchase price paid for the app, if any.
- SleepMethod is responsible for addressing claims concerning the app, including product liability, legal compliance, consumer protection and privacy claims.
- SleepMethod is responsible for investigating claims that the app infringes third-party intellectual property rights.
- You must comply with applicable third-party terms when using the app.
- Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.
